Affiliate Agreement

Earn 30% commission with the 29 Days To A Smooth Move Affiliate Program!

The agreement below outlines the terms and conditions for joining the 29 Days Affiliate Program. You must read and agree to these terms prior to signing up as 29 Days Affiliate.

In the terms below, you as the applicant are considered the "Affiliate" and "We" or "Our" refers to Donna Kozik and Tara Maras, authors, 29 Days To A Smooth Move.

We utilize "Clickbank" as our payment processor and affiliate tracking program.

Nickname and Personal Link
You will be prompted to choose a "nickname" when you register with ClickBank. Your nickname will be used in your personal affiliate "hoplink" which will ensure that sales originating from your Web site are credited to your ClickBank account. This is described in full detail in Step 3 of the Affiliate "Sign Me Up" section.

Sales Commission
You will receive 30% of the revenue as a commission from sales placed through your personal affiliate hoplink, (see the charges outlined by ClickBank in their agreement see http://www.clickbank.com/paychecks.html). For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered. Commissions will only be paid on sales that are made through qualified Affiliate links.

Payment
ClickBank will send a check for the applicable commissions within the framework of their policies http://www.clickbank.com/paychecks.html. If any order that generated a referral fee is returned by the customer, or if there are any returned checks or charge-backs, the amount will be deducted by ClickBank from the next payment.

Book Order Fulfillment
29 Days To A Smooth Move will be the party responsible for processing and delivering every electronic order submitted and paid for via the Affiliate's ClickBank hoplink.

Patrons
29 Days To A Smooth Move book buyers are customers of 29 Days To A Smooth Move. All rules, guarantees and policies regarding customers and order fulfillment will apply to book buyers. We reserve the right to alter our standard operating procedures at any time. 29 Days To A Smooth Move will always be solely responsible for setting the price paid by the customer. If the price should change, 29 Days To A Smooth Move will notify all known affiliates.

Commission Policy
In order to receive your 30 percent commission, all affiliates must refer Web site visitors to www.29DaysToASmoothMove.com via ClickBank hoplinks from their Web sites, newsletters, e-zines, media releases or banners in order to qualify for commissions.

Affiliate Discretion
29 Days To A Smooth Move reserves the right to refuse affiliate status to sites based on content. Sites proposing Affiliate status containing the following will be rejected:

• Sexual promiscuity

• Violence

• Any form of discrimination

• Endorsement of illegal or inappropriate activities

• Violation of intellectual property rights

Spam Policy
29 Days To A Smooth Move does not endorse or participate in sending mass unsolicited e-mails (spam). Affiliates are expected to uphold this standard. Violations to this policy will result in the termination of this contract and removal from the 29 Days Affiliate Program -- no refunds -- no exceptions.

Business Relationship
By becoming a 29 Days Affiliate, you are an independent contractor. There is no opportunity for partnership, joint venture, agency, franchise, sales representative or employment relationship between the Affiliate and 29 Days To A Smooth Move.

Affiliates do not have the right or authority to act on behalf of 29 Days To A Smooth Move.

29 Days To A Smooth Move does not have the right or authority to act on behalf of its Affiliates.

Limitation of Liability
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under to this Agreement.

Disclaimers
We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate links will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

Any disputes between the parties to this agreement which involves interpretations of the terms of this agreement shall be submitted to arbitration under the rules of the American Arbitration Association, and the finding of the Arbitrator shall be binding on all parties. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

By registering with ClickBank and using the 29 Days To A Smooth Move personal affiliate hoplink, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee, or statement other than as set forth in this agreement.
